Terms of service
Last updated
These terms cover your use of phototoquilt.com and anything you buy from us. We've kept them as plain as we can.
1. Who we are
PhotoToQuilt is a business name of Arceteer Inc., 570 Hood Road, Unit 14, Markham, Ontario L3R 4G7, Canada ("we", "us"). You can reach us at support@phototoquilt.com. By using the site or buying from us, you agree to these terms. If you don't agree, please don't use the site.
2. What PhotoToQuilt does
PhotoToQuilt turns a photo you choose into a pixel quilt pattern: a grid of fabric squares matched to fabric colors, with a fabric list, yardage, a cutting list and a printable PDF. The pattern is made in your web browser. Your photo is not uploaded to us.
The preview is free. The full pattern PDF is sold one pattern at a time, or as part of a Pro subscription.
3. Your photos
- Only use photos you took yourself or have permission to use.
- You keep all rights to your photos. Because your photo stays on your device, we never receive, store or see it.
- You're responsible for what you upload and for how you use the pattern made from it.
4. Buying a pattern
- A single pattern costs $9 US dollars. Sales tax, VAT or GST is added at checkout where it applies. You see the total before you pay.
- Payments are handled by Stripe and its affiliates, who process transactions for us. Depending on where you live, your order may be sold through Link, Stripe's checkout service, which then handles sales tax and payment support. In that case Link's terms of sale also apply, and your card statement may show "LINK.COM*".
- After payment, the full pattern PDF downloads in your browser and Stripe or Link emails you a receipt. Download and save your PDF; because your photo stays on your device, we can't recreate the pattern for you later.
- Prices may change, but a change never affects a purchase you've already made.
5. Pro subscription
- Pro costs $15 US dollars a month, plus any sales tax. It renews automatically every month, on the date you first subscribed, until you cancel.
- You can cancel any time from your account page or by emailing us. Pro then stays on until the end of the month you've paid for, and you won't be charged again.
- If we change the Pro price, we'll email you at least 30 days before your next renewal at the new price, so you can cancel first if you wish.
- Pro accounts are for one person or one business. Please don't share your sign-in.
6. Refunds
A single pattern can be refunded in full within 30 days, no questions asked. Pro can be cancelled any time, and your first Pro payment can be refunded within 14 days. The details and how to ask are on our refunds and cancellations page, which is part of these terms.
7. What you may do with your pattern
Single pattern
- Print it as many times as you need, and sew as many quilts from it as you like.
- Give or sell the quilts you sew from it.
- Don't sell, share or publish the pattern PDF itself.
Pro
- Everything a single pattern allows, plus a commercial-use license: you may make patterns for your customers and sell them, including custom photo quilt patterns, under your own name.
- Patterns you made while you had Pro keep this license after you cancel.
- Don't resell access to PhotoToQuilt itself, or offer the tool as a service of your own.
The PhotoToQuilt name, website and software stay ours. These terms don't give you any rights to them beyond using the site as intended.
8. Fabric colors and quilt math
We match your photo to real fabric colors and work out the yardage carefully, but screens show colors differently, and fabric dye lots vary. Check colors against a physical color card before you buy fabric. It's sensible to buy a little extra fabric for mistakes and trimming.
Kona® is a registered trademark of Robert Kaufman Fabrics. PhotoToQuilt is not affiliated with or endorsed by Robert Kaufman or any fabric manufacturer. On-screen colors are approximate; check against a physical color card before buying fabric. Other fabric names belong to their manufacturers.
9. Using the site fairly
Please don't break or overload the site, try to get around payment, copy the site or its software, or use it for anything unlawful. We may suspend access for anyone who does.
10. Our responsibility to you
We provide PhotoToQuilt as it is and as available. We work hard to make it accurate and reliable, but we can't promise it will always be available or free of mistakes. As far as the law allows, we aren't responsible for indirect losses (such as the cost of fabric or time spent sewing), and our total responsibility to you for any claim is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms takes away rights you have under consumer protection laws where you live.
11. Changes to these terms
We may update these terms. When we do, we'll change the date at the top of this page, and we'll email Pro subscribers about any important change before it takes effect. The terms in force when you buy apply to that purchase.
12. Law that applies
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.
